Terms of Service

These Terms of Service ("Terms") govern your use of the Lupa Vision mobile application ("Lupa", "the App") operated by Orange Hill GmbH ("we", "us", "our").

By downloading, installing, or using Lupa, you agree to these Terms. If you do not agree, do not use the App.

1. The Service

Lupa is a camera-based reading companion for iOS. It allows you to point your phone camera at text, select words by tapping or speaking, and receive definitions and translations. The service includes:

• Local dictionary lookups (WordNet) — available to all users, offline-capable
• AI-powered translations — available to authenticated users, subject to tier limits
• Voice word selection — speak a word while holding your finger on screen to select it; audio is transcribed via a third-party speech-to-text service
• Lookup history and favorites — stored locally and optionally synced to our servers
• Photo and audio storage — optional, available to all signed-in users (controlled via "Save Media" in Settings); includes snapshots and voice audio clips

2. Accounts

2.1 Registration

Some features require an account. You can sign in using Apple Sign-In, Google Sign-In, or email (magic link). You must:

• Provide accurate information
• Keep your account credentials secure
• Be at least 16 years old

2.2 Account Security

You are responsible for all activity under your account. If you suspect unauthorized access, contact us immediately at privacy@orangehill.ai.

2.3 Account Deletion

You may delete your account at any time through Settings > Delete Account in the App, or by emailing privacy@orangehill.ai. Deletion permanently removes your profile, history, favorites, stored photos, and audio clips from our servers.

3. Subscription Plans

3.1 Tiers

Specific limits for the free tier are displayed in the App and may be adjusted from time to time.

3.2 Free Trial

Authenticated users may activate a one-time 7-day free trial of premium features. The trial does not auto-renew and does not require payment information. When the trial expires, your account reverts to the free tier. You retain access to all previously saved data.

3.3 Premium Subscriptions

Premium subscriptions are available as monthly or yearly plans, purchased through Apple's App Store using StoreKit. By subscribing, you also agree to Apple's terms:

Pricing is displayed in the App at the time of purchase and may vary by region based on App Store pricing.

Renewal: Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.

Cancellation: You can cancel your subscription at any time through your Apple ID settings (Settings > Apple ID > Subscriptions). Cancellation takes effect at the end of the current billing period. You retain premium access until that date.

Refunds: Refund requests are handled by Apple. Visit reportaproblem.apple.com to request a refund.

4. Acceptable Use

You agree not to:

• Use Lupa for any unlawful purpose
• Attempt to reverse-engineer, decompile, or extract source code from the App
• Interfere with or disrupt the service or its servers
• Use automated means to access the service (bots, scrapers)
• Circumvent usage limits or subscription tier restrictions
• Share your account credentials with others
• Upload content that is illegal, harmful, or infringes on the rights of others

We reserve the right to suspend or terminate accounts that violate these terms.

5. Intellectual Property

5.1 Our Property

Lupa, its design, code, branding, and content are the property of Orange Hill GmbH and are protected by copyright and trademark law. "Lupa" and "Lupa Vision" are trademarks of Orange Hill GmbH.

5.2 Your Content

You retain ownership of any photos and audio clips you upload through the App. By uploading photos or audio clips, you grant us a limited license to store and display them to you as part of the service. We do not use your photos or audio clips for any other purpose.

5.3 Dictionary Data

Local dictionary definitions are provided by WordNet, a lexical database developed by Princeton University. WordNet is used under its license. AI-powered translations are generated by third-party language models and are provided "as-is" without guarantee of accuracy.

6. AI-Generated Content

Translations and definitions provided by the AI feature are generated by third-party language models. Voice transcriptions are processed by third-party speech-to-text services. While we strive for accuracy:

• AI translations are not guaranteed to be correct, complete, or appropriate for all contexts
• Voice transcriptions may not accurately reflect what was spoken
• AI results should not be relied upon for professional, legal, medical, or safety-critical translations
• We are not responsible for errors, omissions, or misinterpretations in AI-generated or AI-transcribed content

7. Privacy

Your use of Lupa is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

8. Availability and Changes

8.1 Service Availability

We aim to keep Lupa available at all times but do not guarantee uninterrupted service. We may temporarily suspend the service for maintenance, updates, or circumstances beyond our control.

8.2 Changes to the Service

We may update, modify, or discontinue features of Lupa at any time. Material changes to paid features will be communicated in advance. If we discontinue the service entirely, we will provide reasonable notice and honor active subscription periods.

8.3 Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the App or by email. Your continued use after changes constitutes acceptance of the updated Terms.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• Lupa is provided "as-is" and "as available" without warranties of any kind, express or implied
• We do not warrant that the App will be error-free, uninterrupted, or free of harmful components
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
• Our total liability for any claim arising from these Terms or your use of the App is limited to the amount you paid us in the 12 months preceding the claim, or EUR 100, whichever is greater

Nothing in these Terms excludes or limits liability for: death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded under applicable law.

10. Indemnification

You agree to indemnify and hold harmless Orange Hill GmbH and its officers, directors, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the App.

11. Governing Law and Disputes

These Terms are governed by the laws of Austria, without regard to conflict of law provisions.

Any disputes arising from these Terms or your use of Lupa shall be subject to the exclusive jurisdiction of the courts of Vienna, Austria.

If you are a consumer residing in the EU, you also have the right to bring proceedings in your country of residence and are entitled to the protections of the mandatory consumer protection laws of your country.

For alternative dispute resolution, EU consumers may use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.
